During the evening of Thursday, April 30, NPR broke the news that Justice David Souter plans to retire at the end of this term, opening a vacancy on the Supreme Court as early as June of this year. With commentators expecting the creation of a 60 vote Democratic majority in the Senate, Obama will likely have wide leeway to consider the appointment of a replacement. Justice Souter was cited as longing to return to his native New Hampshire to pursue a simpler, rural life while young enough to be healthy and mobile.
